THE High Court in Mombasa yesterday reversed the release on bond of two sons of the slain drug baron Ibrahim Akasha and two foreigners.
Judge Anyara Emukule said the four were released improperly as the prosecution was not involved.
He said both the prosecution and the defence should have been involved in the verification of the surety documents.
“The release of the respondents was irregular. I therefore nullify the process and order it done in the right way,” Emukule said.
On Monday, judge Martin Muya released Baktash Akasha, Vijaygiri Anandgiri, Gulam Hussein and Ibrahim Akasha on Sh30 million bond each.
He upheld the decision by judge Maureen Odero after the DPP asked for the review of the four being released on bail pending extradition procedures. Assistant Director of Public Prosecutions Alexander Muteti had asked the court to issue stay orders restraining the release of the four until the process is done in the right manner.
Muteti told the court he has filed a notice of appeal to stop the release of the four on bond.
